1. Native American Kennels offers all buyers a health guarantee until the puppy reaches 1 year old, that your puppy will be free from any debilitating genetic or hereditary health problems (i.e. –hip dysplasia, etc.). If you feed a high quality dog food as listed in your packet and give NuVet Plus and NuJoint, the health guarantee will be extended until the dog reaches 3 years old. NuVet products must be fed for the full 3 years or the EXTENDED health guarantee is null and void. The guarantee would then convert back and cover the dog to the age of 1 year old only. It is recommended by Native American Kennels that you keep your dog on the NuVet products indefinitely.
2. The Buyer must have the puppy examined by a licensed veterinarian within seven (7) days of receipt of the puppy A copy of the examination (medical record) must be sent to the Seller by e-mail or mail within six (6) days of receipt of the examination. Failure to comply will render this guarantee void.
3. The Buyer is responsible for the daily health care and maintenance of the pet, including all immunizations and examinations recommended after purchase, as well as providing necessary medication and follow-up treatments from veterinarian visits. The Seller will have properly dewormed the puppy with Pyrantel Pamote up to the departure date. It is the buyer’s responsibility to continue proper deworming after receipt. The puppy will have at least the first puppy vaccination administered before leaving the kennel. The Buyer understands that intestinal parasites (including hookworms, roundworms, whipworms, occidian, and giardia) are considered a normal occurrence. In order for the guarantee to remain in effect you must keep receipts and records to verify that you have taken your pet to a duly licensed veterinarian for checkups and all required immunizations. Seller is not responsible for conditions caused by neglect or abuse, and will require immediate return of this puppy under such conditions to avoid notification of the proper local authorities.
4. A non-refundable deposit of $385.00 (USD) shall be retained by the Seller should the Buyer decide to cancel any time prior to shipping. This fee is to reimburse the Seller for out-of-pocket expenses and overhead costs associated with the transaction.
5. This guarantee is non-transferable.
6. All puppies are sold as pets and shall be spayed or neutered at twelve (12) months of age unless you have agreed to the Breeders Contract. If spayed or neutered before this the contract is voided.
7. The Seller makes every effort to provide accurate and up-to-date information on the website regarding the puppies they sell. Seller requires one (1) e-mail about your experience with the puppy and a photo at six (6) months and one (1) year of age so it can be posted on our testimonial page.
8. Seller requires Buyer to attend obedience classes with puppy and provide proper socialization opportunities for puppy. Seller shall not be held responsible for acts of puppy, which are due to Buyers negligence.
9. Buyer has to feed a high quality puppy/dog food. A list of these foods will be provided in a packet given to the owner at time of sale. Even if they DO NOT accept the 3 year extended health guarantee. Dog foods that are NOT considered high-end premium diets would consist of all inexpensive brands (i.e.- Ol’Roy, Kibbles ‘n’ Bits, Beneful, Gravy Train, Dog Chow, Purina One, any high grain, low/no meat dog food, dog food with meat-by-products, corn, wheat, soy etc.) Supplementation with a high quality vitamin/mineral supplement, a good probiotic
and digestive enzymes are also encouraged. This will help your new puppy grow strong and healthy and ensure a long life span, as is known to this breed. As stated in paragraph 1 NAK highly recommends NuVet Plus and NuJoint supplements. The buyer must have proof of receipts for the dog food they feed there puppy/dog.
10. Buyer agrees to provide adequate food and water, vet care, shelter, and protection from the elements and that puppy will not be crated or chained/cabled for extended periods of time or for any permanent period of time. Puppy is being sold to Buyer with the understanding that the puppy will be allowed to spend time outdoors to run in order to get the needed exercise, in a fenced area or a protected area safe from harm, as well as indoors with the family daily and will be treated humanely.
11. Native American Kennels will not be responsible for any veterinary bills and/or diagnoses occurring from any puppy/dog sold, after the puppy/dog leaves the kennel premises. This will be done at the puppy/dog owner’s expense. Native American Kennels takes all necessary precautions to insure your puppy/dog arrives at its new home in good health. We cannot be responsible for any exposure the puppy/dog receives once it leaves our kennel.
12. Transportation of the puppy is arranged through third-party carriers. Occasionally there may be delays for numerous reasons including, but not limited to, weather, temperature restrictions, logistics, mechanical failure, or other unforeseen events. The Seller shall not be liable directly or indirectly for any delays that may cause the Buyer inconvenience or financial loss, nor shall any delay be a valid cause for cancellation. All shipping expenses are the responsibility of the Buyer.
13. Usually the puppy will ship within 7 to 14 days. The final determination of the shipping date for the puppy is made by the Seller or, the Seller's veterinarian, or the airlines schedule, with the health of the puppy being the overriding factor.
14. In the unlikely event of the death of the puppy within one (1) year from its birth due to genetics, the Seller shall replace the pet with another of equivalent value/sex at no cost to the Buyer. As soon as one becomes available. The buyer is responsible for all travel expenses, health certificates, and crate etc. incurred to receive the new puppy/dog.
15. If the Buyer declines the replacement puppy that we have agreed upon, then the Seller shall be under no further obligation and it will be deemed that the Buyer has released the Seller from any and all further claims.
16. In case of severe knee, elbow or hip dysplasia, the radiograph should be permanently identified in the film emulsion with: registered name and/or number, name of the veterinarian or hospital making the film, date of radiograph taken. Furthermore, the radiograph and report must meet OFA’s standard submission requirements. This disorder needs to be confirmed by two (2) unassociated licensed veterinarians. If the veterinarian feels the pet can live a good quality of life by controlling pain and other issues with medication, diet or some other form of treatment, NAK will then require a statement from the Veterinarian outlining the required care necessary for the puppy or dog and a written agreement from the owner stating they will provide such care for the dog’s remaining years. Owner must agree to uphold the required treatment and medications. If owner wants to keep the dog and provide the appropriate treatment and once the required info is received a replacement puppy will be offered when one becomes available.
17. Should puppy exhibit aggressive behavior, which Buyer deems intolerable and irreversible within 12 months after purchase, Buyer will provide Seller with proof that puppy/dog has been sufficiently socialized and that obedience classes and other structured training methods have been attempted and completed with no results. Upon receipt of such proof, evaluations of puppy/dog will be scheduled with three recognized breeders or trainers, one to be chosen by Buyer, one to be chosen by Seller, and one to be chosen jointly. Should puppy/dog be deemed overly aggressive and unable to be rehabilitated by two of the chosen breeders/trainers, Buyer will arrange for euthanasia of puppy/dog and forward a copy of proof of euthanasia to Seller within 48 hours. If it is deemed that the puppy has become aggressive because of abuse and/or mishandling no replacement puppy will be issued. If it is deemed not the fault of the Buyer, Buyer’s family or the Buyer’s trainer, Seller will then provide Buyer with a replacement puppy/dog of the same value/sex as soon as such a puppy/dog is available to Seller. The buyer will be required to pay for all the above services and for any travel expenses etc. to receive the new puppy/dog. No refunds are given. (As of date this never been executed by any buyer.)
18. If the Buyer must return the puppy, the Buyer will be responsible for all shipping costs. Should you find yourself unable to keep this puppy, seller has first right of refusal. Buyer must NOT relinquish this puppy to a rescue or animal shelter of any kind EVER! Seller will help place the puppy in a new home or accept the puppy back. No replacement or refund applies to a puppy that is returned under these circumstances unless we have come to some kind of agreement.
19. The value of the puppy for the purpose of this guarantee is solely the original purchase price of the puppy, and does not include shipping costs, health certificate, shipping crate or any additional prices declared by the Buyer.
20. Buyer agrees to pay all court costs and/or attorney fees incurred by Seller. The venue and jurisdiction for litigation arising out of or related to this contract shall lie exclusively in the state or jurisdiction in which the Seller resides. There are no oral representations or warrant contained herein. In the event the Buyer prevails in litigation, the total awarded value shall not exceed the value of the original purchase price minus the non-refundable deposit.
21. All the above mentioned conditions must be met or all guarantees above mentioned will be void. Temperament issues are not covered under this guarantee as they can be caused by a lack of training, discipline or proper dog socialization, which is a requirement under this contract. The owner is responsible for all transportation costs to and from the Seller.
22. If within one (1) year from the date of purchase from Seller, a dog is found and certified by two (2) unassociated licensed Veterinarian doctors to have congenital or hereditary disorders which adversely affect the health of the animal, and if Seller is notified within two (2) business days of the veterinarian's determination, the Seller will provide a replacement puppy of equivalent value/sex, when one becomes available. The Seller is not responsible for any veterinarian fees, shipping costs or any other associated costs. Seller sells pets for companion purposes only. Seller does not guarantee against non-life threatening illnesses common to puppies.
23. This agreement represents the total agreement between the Seller and the Buyer and no other terms or conditions shall be valid to this sale. The Buyer has read this agreement and agrees to the terms and conditions herein. Should Buyer choose to break any of the above portions of this agreement, the agreement(s) broken herein, and the guarantee will be considered null and void.
I, the purchaser of a puppy from Native American Kennels, hereby acknowledge that I have read, understand, and agree to the terms of this document. This agreement represents the total agreement between Seller, Native American Kennels and the Buyer and no other terms or conditions shall be valid to this sale.

By entering your full legal name in the space provided , you are stating that:
*You have asked all pertinent questions regarding the method by which you will receive your puppy.
*You intend to make a nonrefundable deposit of $385.00 (USD) on the above mentioned puppy. If something happens to your puppy in our care, you can decide if you want a different puppy, or have pick of the next litter. At no time will Seller refund money. We will however hold it for a future pup when you are ready. Once we receive your deposit we will mark your puppy as “sold.” If we do not receive your deposit within 5 days we cannot hold the puppy of your choice and it will be re-listed for sale. If you are mailing your deposit it is best to use priority mail to ensure that we receive it within the 5 days.
*You understand that final payment, including all shipping charges are due in full by 8 weeks of the puppies birth date. All payments must be made before puppy is allowed to leave the kennel.
*Puppies can be picked up at 8 weeks of age. If you are picking up your puppy you must do so by the time he/she is 8 weeks old. If you do not pick up your puppy by that time, there will be a $5.00 per day added to your puppy price until your puppy is picked up by you. If the puppy is not picked up by 9 weeks of age the puppy will be listed for resale and the buyer will be moved to the next liters waiting list.

SPAY AND NEUTER CONTRACT
Buyer understands that spay or neuter is required for this puppy.
Buyer understands that failure to provide proof of spay/neuter by the time the puppy is
twelve months old will void all warranties stated within the sales contract. We do not encourage spaying/neutering earlier than this as the hormones help build muscle and make for stronger support around the joints. Proof of spay/neuter must be a receipt from the veterinarian giving the date of the procedure, the exact procedure performed, and the veterinary clinic name, address and phone number. Buyer is to e-mail or mail the copy to us within 5 business days of the spay/neuter. Once I receive a copy of your proof of spay/neuter receipt from your veterinary clinic, I will forward the registration papers to you for your puppy. Native American Village Dogs are registered with The North American Purebred Registry (NAPR). Buyer understands that in the event that the spay/neuter contract is broken, there could be legal action taken to uphold this contract. Buyer is responsible for all court and/or attorney fees incurred by the Seller.
